Attention all Property Owners and Builders:
Everyone constructing a home within the Semiahmoo community is bound by Article X of the Semiahmoo Covenants, Conditions and Restrictions (CC&R’s). The rules contained within Article X govern all home construction activities such as: when you are able to begin your construction; the time allowed for construction and landscaping; acceptable construction site behavior; and site cleanliness. Article X also governs existing homes for exterior changes, tree removal requests, etc.
On November 27, 2001, the Semiahmoo Resort Association (SRA) Board of Directors approved a schedule of fines to be levied at such times that the Architectural Standards Committee (ASC) members ascertain that non-compliance with the CC&R’s has occurred during construction. This schedule of fines was recently revised as depicted below.
The Board has the authority to impose the fine. The following is a listing of the most commonly encountered non-compliance issues and the amount of the fine that will be levied upon the person in whose name the plans were submitted and formally approved (or in the case of an existing home, the owner who holds title to the property).
The imposition of fines is in addition to other remedies that the Association possesses against an owner that violates CC&R’s, rules and regulations, including the right, in accordance with Section 12.04, to compel removal of any offending structure or improvement constructed in violation of the CC&R’s, rules an/or bylaws and the right to collect attorneys’ fees and costs incurred by the Association in collecting unpaid fines.
